Purpose of the Application(s): |
The subject lands received Draft Plan of Subdivision Approval and Zoning By- Law Amendment at the Ontario Land Tribunal (OLT) in April 2024 (S1-20 and Z5-20). At that time, Blocks 63 and 64 of the Draft Approved Plan of Subdivision were to remain as employment blocks. The purpose of the Official Plan Amendment (OPA1-26) and Zoning By-law Amendment (Z7-26) are to convert the previously proposed Blocks 63 and Block 64 from employment to residential uses. The proposed conversion is intended to facilitate future residential development on those lands and a future revision to the Draft Plan of Subdivision.
The applicant is seeking a Township Official Plan Amendment to redesignate the Employment lands on the eastern portion of the property to Community Residential. The proposed conversion of employment lands is intended to permit residential uses.
The applicant is also seeking a Zoning By-law Amendment to rezone the portion of the property zoned Rural Exception Twelve (RU-12) and Rural Exception Thriteen (RU-13) to a Hamlet Residential Exceptions (HR-X) Zone.
Concurrently, the applicant has submitted a County Official Plan Amendment to Dufferin County to the conversion of Employment Lands to Community Settlement Area. This application is currently being reviewed by Dufferin County. The County of Dufferin is the approval authority for Township Official Plan Amendments. |

Please note the Statutory Public Meeting for the proposed Official Plan Amendment and Zoning By-Law Amendment applications will not be scheduled at this time and further notice will be given pursuant to the Planning Act, as amended, once the Public Meeting date has been determined.
Zoning By-Law Amendment
If you wish to be notified of the decision of the Council of the Township of East Garafraxa on the proposed zoning by-law, you must make a written request to the Township Clerk at clerks@eastgarafraxa.ca or 065371 Dufferin County Road 3, Unit 2, East Garafraxa, ON L9W 7J8.
If a person or public body would otherwise have an ability to appeal the decision of the Council of the Corporation of the Township of East Garafraxa to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Township before the by-law is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Township before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
Official Plan Amendment
If a person or public body would otherwise have an ability to appeal the decision of the Council of the County of Dufferin to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of East Garafraxa before the proposed Official Plan Amendment is adopted, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the Township of East Garafraxa before the proposed Official Plan Amendment is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
If the proposed Official Plan Amendment is adopted by the Council of the Township of East Garafraxa, it will be submitted to the County of Dufferin for approval. If you wish to be notified of the decision of the County of Dufferin, in respect of the proposed Official Plan Amendment, you must make a written request to:
