NOTICE OF THE PASSING OF A ZONING BY-LAW AMENDMENT

FOR THE CORPORATION OF THE TOWNSHIP OF EAST GARAFRAXA

TAKE NOTICE THAT the Council of the Township of East Garafraxa passed By-Law Number 41-2026 on the 28th  day of July 2026  under Section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended.

AND TAKE NOTICE THAT any person or public body may, no later than the 19th day of August 2026, appeal to the Ontario Land Tribunal (OLT) by filing with the Clerk of the Township of East Garafraxa a notice of appeal setting out the objection to the by-law and the reasons in support of the objection, and shall be accompanied by the applicable fee required by the Tribunal. A copy of the appeal form is available at https://olt.gov.on.ca/appeals-process/forms/.

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

PURPOSE AND EFFECT OF THE BY-LAW:

If no appeals have been received on or before the above-mentioned appeal date, the subject lands, located at Concession 16, West Part of Lot 15, Part 1 on 7R2721 under Zoning By-Law 60-2004 as amended, will be rezoned from Rural (RU) Zone to the Industrial Exception Two (M1-2) from the Environmental Protection (EP) Zone to the Industial Exception Two (M1-2) Zone, and from the Rural (RU) Zone to the Environmental Protection (EP) Zone, as identified on Schedule “A” to By-Law 41-2026 to permit: 

Notwithstanding the Permitted Uses of the Industrial (M1) Zone, the following use is also permitted;

 

Utility Facility Workshop: Means a building or part of a building used to clean, maintain, repair or replace parts, refurbish, sell, lease, or rent heavy equipment for the purpose of boring, tunnelling or drilling, which is primarily associated with the Utility industry. Screened outside storage, and accessory buildings and uses are also permitted along with this use.

Additionally, the existing dwelling on lands zoned as M1-2 will be permitted as a legal non-conforming use, subject to the provisions of Section 3.11 of the Zoning By-law No. 60-2004, as amended.

Notwithstanding the provisions of Section 3.25.6 (Special Setbacks – Wetlands), a reduced setback of 15.9 metre shall be permitted from the edge of a wetland to an existing storage building. The 15.9 metre setback shall be measured as being inclusive of the 10 metre wetland buffer.

In all other respects, the provisions of Zoning By-law No. 60-2004, as amended, shall apply.”
