Beneficiary Lands at 191064 13th Line: Rural Residential Exception (RR-X)

Purpose:

Consent Application: The owners of 191064 13th Line would like to acquire a portion of land from the adjacent farms to increase the size of their undersized lot. A lot line adjustment severance application has been submitted to sever 0.3318 ha from 191096 13th Line and 0.0429 ha from 191028 13th Line. The proposed lot line adjustment would create a larger parcel at 191064 13th line to XX ha in size. 

The retained parcel on 191096 13th Line would be approximately 40.8ha and the retained parcel on 191028 would be approximately 40.1ha. The proposal will not create a new lot. 

Zoning By-law Amendment Application: To rezone the beneficiary lands from Rural Residential (RR) to a site-specific Rural Residential exception zone (RR-X). The rezoning is necessary to permit a reduced minimum interior side yard setback and to recognize undersized minimum lot area. The Zoning By-law Amendment will also rezone the severed lands from Agricultural (A) to Rural Residential exception (RR-X) to establish consistent zoning on the beneficiary lands as a result of the lot line adjustment.

Written comments will be accepted for consideration by Council prior to Council making a decision on the applications. You may forward your written comments to the Clerk at the address shown above. 

 

ZONING BY-LAW AMENDMENT: FAILURE TO ATTEND PUBLIC MEETING OR PROVIDE WRITTEN SUBMISSIONS: If a person or public body would otherwise have an ability to appeal the decision of the Council of the Township of East Garafraxa to the Ontario Land Tribunal but the person or public body does not make oral submissions  at a public meeting or make written submissions to the Council of the Township of East Garafraxa before the by-law is passed, the person or public body is not entitled to appeal the decision. If a person or public body does not make oral submissions at a public meeting, or make written submission to the Council of the Township of East Garafraxa before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

 

CONSENT: FAILURE TO MAKE WRITTEN SUBMISSIONS: If a person or public body has the ability to appeal the decision of the Council of the Township of East Garafraxa in respect of the proposed consent to the Ontario Land Tribunal but does not make written submissions to Council of the Township of East Garafraxa before it gives or refuses to give a provisional consent, the Tribunal may dismiss the appeal.

 

DECISION: If you wish to be notified of the Decisions of the Council of the Township of East Garafraxa on the proposed consent and/or Zoning By-Law Amendment applications you must submit a written request to the Township of East Garafraxa at the address above noted. This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing.
